Manhattan D.A. Alvin Bragg will charge Daniel Penny with second degree manslaughter after he choked Jordan Neely to death on the MTA on May 1st. Formal charges will be laid after Penny is arrested, taken into custody and arraigned possibly as soon as tomorrow.
Second degree manslaughter is a Class C felony in New York State and, if found guilty, Penny could face up to 15 years in prison. Of course, the key phrase here is “if found guilty”. The sad truth is there are a lot of New Yorkers who think Penny is a hero for choking a black, homeless man to death. They look upon people like Neely as subhuman savage who deserved to die.
With that said, there are also many New Yorkers who are appalled by Penny’s actions and would like to see justice served for Jordan Neely. The burden is on Bragg’s office to convince a jury of reasonable people to unanimously agree that Penny acted unreasonably. This is, of course, assuming a jury of reasonable people can be found.
