President-elect Donald Trump can always count on Judge Aileen Cannon.
Yesterday, Judge Cannon blocked the release of Special Counsel Jack Smith's report in the classified documents case against Trump which Smith dropped after the November election.
Back in July, Judge Cannon threw out the classified documents case against Trump ruling that Merrick Garland's appointment of Smith as a special prosecutor was unconstitutional because he had not been confirmed by the Senate. The ruling has been appealed to the 11th Circuit Court of Appeals as has yesterday's ruling.
Of course, neither of Judge Cannon's rulings pass constitutional muster. That's because Judge Cannon's rulings aren't in the interest of justice. They are in the interest of President-elect Trump and he will reward her handsomely for it. Consider what I wrote after Judge Cannon's ruling in July:
As with the U.S. Supreme Court in the presidential immunity case, Judge Cannon has demonstrated time and again that her oath is to Donald Trump, not the U.S. Constitution. This ruling, however, will be what cinches her Supreme Court appointment should Trump get back into the Oval Office. And if there is no vacancy then Trump might very well create one for her. After all, who would stop him?
Now that Judge Cannon has gone one step further for Trump, the question is how long it will be before she gets her Supreme Court appointment. This could depend on the rulings of the 11th Circuit and how long it will take to get to the Supreme Court as well as the disposition of the cases against Trump's former co-defendants Walt Nauta and Carlos De Oliveira.
It is worth noting that Cannon was under consideration to be Trump's nominee for Attorney General. However, it serves Trump's interest to keep her in the District Court in Florida and Judge Cannon was more than happy to oblige.
Nevertheless, I suspect a promotion will take place sooner rather than later. Methinks the most likely scenario is that the 76-year-old Clarence Thomas will be encouraged to retire thus creating an opening for Trump to appoint Cannon. After all, she is more than 30 years younger than Thomas and could easily serve three perhaps four decades on the U.S. Supreme Court. Given what she has been prepared to do to aid and abet and Trump, I shudder to think what she could do to American justice especially to those among us upon whom Trump looks unfavorably.
